Terms of Service

These terms govern access to and use of Elevate OS, the platform operated by Elevate Weekly LLC. They are written to be read.

1. Acceptance of these terms

By accessing or using Elevate OS, you agree to these terms. If you are using Elevate OS on behalf of a company or other organization, you confirm that you are authorized to accept these terms for that organization, and “you” includes that organization.

If your organization has a separate written agreement with Elevate Weekly LLC covering services or deliverables, that agreement governs the work described in it. These terms govern use of the platform.

2. What Elevate OS is

Elevate OS is a private, invitation-based platform for marketing intelligence, analytics, production collaboration, and client communication. Depending on the arrangement with your organization, it may be used to manage requests and projects, review and approve work, exchange files and messages, connect marketing data sources, and read reporting drawn from them.

3. Business and professional use

Elevate OS is intended for business and professional use by adults. It is not a consumer product and is not directed to children.

4. Accounts and eligibility

  • Accounts are created by invitation. You may not use an account you were not given, or allow someone else to use yours.
  • You are responsible for the accuracy of the account information you provide and for keeping it current.
  • An organization’s administrators may add, change, or remove access for people in their organization, and may see and manage the work in that organization’s workspace.
  • You must be authorized by your organization to act on its behalf in the workspace.

5. Credentials and account security

  • Keep your password and any sign-in codes confidential. They are for you alone.
  • You are responsible for activity that occurs under your account.
  • Tell support@elevateweekly.com promptly if you believe an account has been compromised or accessed without permission.

6. Connected third-party accounts

Elevate OS can connect to third-party marketing and analytics services — for example services provided by Google, Meta, and LinkedIn, and comparable sources added in future — so that reporting can be produced from them.

  • You may only connect an account you are authorized to connect. By connecting one, you confirm you have the authority to grant that access on behalf of the account’s owner.
  • What we can retrieve is limited by the permissions you grant and by what the provider makes available.
  • Those services are operated by third parties and are subject to their own terms, privacy policies, permission models, availability, and API changes. We do not control them.
  • A provider may change or withdraw access, and a connection may stop working as a result. We are not responsible for a third party’s decisions about its own platform.
  • You may withdraw an authorization at any time, through the connection controls where they are available or directly with the provider.

Third-party integrations are made available as Elevate OS supports them. Nothing in these terms is a commitment that a particular integration exists, will continue to exist, or will be added.

7. Acceptable use

You agree not to:

  • Access or attempt to access another organization’s data, or any account, record, or area you were not granted.
  • Probe, scan, or test the security of the service, or interfere with its normal operation.
  • Upload malicious code, or content that is unlawful, infringing, or that you do not have the right to share.
  • Use the service to send unsolicited bulk messages, or in a way that breaches a third-party platform’s policies.
  • Copy, resell, sublicense, or make the platform available to anyone outside your organization.
  • Reverse engineer the platform, or use automated means to extract data from it beyond the features provided.
  • Misrepresent your identity, your authority, or your relationship with an organization or a connected account.

8. Your content, and who owns what

Content and materials you submit — briefs, files, assets, messages, and the data retrieved from accounts you connect — remain yours or your organization’s. You grant Elevate Weekly LLC permission to host, process, and use that material as needed to operate the service and to carry out the work your organization has asked for.

The Elevate OS platform itself — the software, interface, design, and underlying systems — belongs to Elevate Weekly LLC. These terms grant your organization the right to use it while your access continues; they do not transfer ownership of it.

Ownership of work commissioned separately from Elevate Weekly LLC — creative, production, or marketing deliverables — is determined by the agreement or statement of work covering that engagement, not by these platform terms. Using Elevate OS to deliver work does not, by itself, transfer ownership of that work in either direction.

You are responsible for having the rights to the material you submit, including any content owned by a third party.

9. AI-assisted functionality

Some Elevate OS features use AI-assisted processing to summarize activity, draft text, and help interpret marketing performance. To provide them, relevant information may be processed by third-party service providers, as described in the Privacy Policy.

AI-assisted output can be incomplete or wrong. It is provided to support your judgement, not to replace it. You remain responsible for reviewing anything that informs a marketing, business, financial, legal, or compliance decision before acting on it.

10. Intelligence and recommendations are informational

Reporting, insights, and recommendations in Elevate OS are informational. They are produced from data retrieved from connected sources, which may be incomplete, delayed, or changed by the provider. Nothing in the product is a guarantee of traffic, ranking, conversion, revenue, or any other business outcome, and nothing in it is legal, financial, tax, or professional advice.

11. Availability and changes to the service

We aim to keep Elevate OS available and working well, but we do not promise uninterrupted or error-free operation. Maintenance, updates, third-party outages, and circumstances outside our control can all interrupt it.

We may add, change, or discontinue features. Where a change would materially reduce functionality your organization depends on, we will take reasonable steps to give notice.

12. Suspension and termination

We may suspend or terminate access where it is reasonably necessary — for a breach of these terms, for conduct that threatens the security or integrity of the service, where required by law, or when an organization’s engagement with Elevate Weekly LLCends. Where circumstances allow, we will give notice first.

Your organization may stop using Elevate OS at any time and ask for access to be removed by writing to support@elevateweekly.com.

13. Account and data deletion

You can request deletion of applicable account information and connected marketing data at any time. The process, what may be deleted, and how connected services are handled are set out on the Data Deletion page. Some records may be retained where there is a legal or legitimate business reason to keep them.

14. Disclaimers

To the fullest extent permitted by law, Elevate OS is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will meet your requirements, that it will be uninterrupted, or that data retrieved from a third-party service will be accurate or complete.

15. Limitation of liability

To the fullest extent permitted by law, Elevate Weekly LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, lost business, or lost or corrupted data, arising out of or related to your use of Elevate OS.

To the fullest extent permitted by law, our total liability arising out of or related to these terms or to Elevate OS will not exceed the amounts your organization paid to Elevate Weekly LLC for the service giving rise to the claim in the twelve months before the claim arose.

Nothing in these terms limits liability that cannot be limited under applicable law. Some jurisdictions do not allow certain exclusions, in which case the exclusions above apply only to the extent permitted there.

16. Changes to these terms

We may update these terms as the service and its legal requirements change. The “last updated” date at the top of this page changes with them, and where a change is significant we will take reasonable steps to make it known. Continuing to use Elevate OS after an update means the updated terms apply.
